Limited Lifetime
Warranty Agreement
Cobra Kayaks / Aquatx Distribution Corp. warrants, to
the original recreational purchaser,
with the original
proof of purchase,
their kayaks, to
be free of manufacturing
defects in workmanship
and materials, from
the original date
of purchase, for as
long as they own the
product. This warranty
does not include damage
to the products resulting
from abuse, misuse,
accidental or normal
wear and tear. Warranty does not apply to commercial use, rentals, outfitters, demonstration boats or BLEMS (these boats have a 90 day warranty). All
warranty items shall
be returned to the
original dealer. All
shipping costs shall
be the responsibility
of the original purchaser.
The dealer shall contact
Cobra Kayaks to report
warranty issues. Cobra
Kayaks will elect
to repair or replace
it. The foregoing
warranty is exclusive
and is given and accepted
in lieu of any and
all other warranties,
express or implied,
including, without
limitation, the implied
warranty of fitness
for a particular purpose
and the implied warranty
of merchantability.
The remedies of the
purchaser for any
breach of warranty
shall be limited to
those provided herein
to the exclusion of
any and all other
remedies including,
without limitation,
incidental or consequential
damages. No agreement
varying or extending
the foregoing warranty
remedies or this limitation
will be binding upon
seller unless in writing,
signed by a duly authorized
officer of seller.
Some states do not
allow the exclusion
or limitation of incidental
or consequential damages,
so the above limitation
or exclusion may not
apply to you. This
warranty gives you
specific legal rights,
and you may also have
other rights which
vary from state to
state. This warranty
is valid only in the
U.S.A.
